EEOC Settles First GINA Lawsuit

(May 7, 2013) The Equal Employment Opportunity Commission (EEOC) has settled the first lawsuit under the Genetic Information Nondiscrimination Act (GINA). Although GINA has been law since 2009, many employers still do not understand that requesting family medical history, even through a contract medical examiner, violates the law.

Addressing emerging and developing issues in EEO law, such as genetic discrimination, is one of the EEOC’s six national priorities in its strategic enforcement.

Fabricut, one of the world’s largest distributors of decorative fabrics, had  an employee in a temporary position as a memo clerk who applied for a permanent job. After the company offered her permanent employment, she was sent to its medical examiner, Knox Laboratory, for a pre-employment drug test and physical.
